Six rules that matter most
Calendar-month earnings pay on or about the following month’s 15th.
A refund or chargeback on the first payment within 60 days reverses the commission.
Earn from customers you refer. Recruiting affiliates does not generate commissions.
Scams, bot or purchased traffic, and illegally obtained referrals forfeit your funds.
Clearly disclose that you earn a commission whenever you promote Sharpr.
1. Eligibility
You must be at least 18 years old and legally permitted to participate in your jurisdiction. You must provide accurate, current enrollment information and keep it updated. Only one Affiliate Program account is allowed per person, and participation is void where prohibited by law. You may not participate if you are located in, ordinarily resident in, or acting on behalf of any person in a jurisdiction subject to comprehensive sanctions, including North Korea, Iran, Syria, Cuba, and Russia. Payouts are processed through Whop and cannot be issued to these regions. The Company may suspend or terminate any account and withhold payment where sanctions or applicable law require it.
2. Independent contractor
You participate as an independent contractor, not as an employee, agent, joint venturer, or representative of B.Davis Management Inc., operating as Sharpr Picks (the Company). You have no authority to bind the Company and are responsible for your own equipment, expenses, insurance, and taxes. The Company may request a completed Form W-9 or other tax documentation and will issue tax forms when required by law.
3. Commission
The standard commission is $50 for each Qualified Referral. A referral qualifies when the referred customer completes their first successful payment. This is a single-level program: you earn only from customers you directly refer and receive no compensation for recruiting other affiliates.
4. Payment schedule
Qualified commissions are grouped into calendar-month cohorts and paid on or about the 15th of the following month. Payment is made through a Whop transfer to a connected Whop user account. If your Whop account is not yet connected, eligible commissions remain held without forfeiture until the account is linked and verified.
5. Clawback provision
If a referred customer receives a refund or initiates a chargeback on their first payment within 60 days after that payment, the associated $50 commission is reversed. Refunds or chargebacks on later renewal payments do not reverse the commission. If the commission has already been paid, the reversal will be deducted from future earnings; your account balance may become negative and future commissions will offset that balance. An ordinary cancellation without a refund or chargeback does not trigger a clawback.
6. Prohibited conduct
You may not self-refer or use your own payment methods, household members, or coordinated accounts to farm commissions; generate fake, incentivized, purchased, or otherwise non-genuine signups; or send spam, including email or SMS that violates CAN-SPAM, the TCPA, or similar laws. Cookie stuffing, forced clicks, iframe or pixel injection, bidding on Sharpr brand keywords, and impersonating Sharpr in advertisements, usernames, social handles, or domains are prohibited. You may not make misleading claims, including guaranteed winnings, “risk-free” offers, promised profits, or fabricated results. You also may not target minors or individuals known to be on self-exclusion lists. Any unlawful, deceptive, fraudulent, or abusive activity is grounds for immediate termination and forfeiture of unpaid commissions.
7. Required disclosures
You must conspicuously disclose your material connection to Sharpr Picks wherever you promote the program, using clear language such as “#ad” or “I earn a commission,” in accordance with FTC guidance. You may not hide or remove Sharpr’s disclaimers. Sports content is provided for informational and entertainment purposes, no result is guaranteed, and you must never represent otherwise. Where relevant, include responsible-gaming language, including 21+ restrictions where applicable and 1-800-GAMBLER.
8. Fraud review
The Company may hold, audit, or withhold a payout while conducting a good-faith review of suspected fraud, abuse, attribution errors, or policy violations. We may request identity, payment, traffic-source, or promotional evidence before releasing funds. A review hold is not a determination of wrongdoing, but unresolved concerns may prevent payment.
8a. Withholding of funds for disapproved acquisition methods
B.Davis Management Inc., operating as Sharpr Picks, reserves the right to withhold, reduce, reverse, or permanently forfeit any and all commissions, balances, and pending payouts, in whole or in part and at its sole discretion, where it determines that an affiliate has obtained or attempted to obtain referrals through disapproved methods. Disapproved methods include, without limitation: scamming, defrauding, deceiving, or misleading any person; bot traffic, automated scripts, click farms, emulators, device farms, or any artificially generated or simulated traffic, clicks, or signups; purchased, incentivized, rented, or otherwise non-genuine traffic or leads; the use of stolen, hacked, or unauthorized payment methods, accounts, identities, or personal data; unauthorized access to any system, network, or account; phishing, malware, adware, browser extensions, redirects, pop-unders, or cookie stuffing; spam or unsolicited communications in violation of CAN-SPAM, the TCPA, or similar laws; impersonating the Company, its staff, or its handles; fabricated results, forged screenshots, or false earnings, winnings, or guarantee claims; promotion on or through platforms, communities, or channels where such promotion is prohibited or where the affiliate has been banned; targeting minors or self-excluded individuals; any traffic obtained illegally or in violation of any applicable law, regulation, platform rule, or third-party terms of service; and any other unethical, abusive, manipulative, or bad-faith conduct the Company reasonably determines to be inconsistent with the integrity of the program, whether or not specifically listed here. The Company may withhold funds pending investigation and may withhold them permanently upon a determination of a violation. Nothing in this section limits any other remedy available to the Company, including account termination, reversal of prior payouts, referral of the matter to law enforcement, and recovery of amounts already paid. Determinations under this section are made by the Company in its sole and reasonable discretion, and its decision is final.
9. Termination
Either you or the Company may end participation at any time. Earned and qualified commissions that remain valid after the clawback period will ordinarily be paid on schedule. If termination results from fraud, prohibited conduct, or another material breach, all unpaid amounts are forfeited.
10. Program changes
The Company may prospectively modify commission amounts, payout timing, program features, or these terms by providing notice through the affiliate dashboard or another reasonable channel. Continued participation after a change takes effect constitutes acceptance of the updated terms. The Company may suspend or discontinue the program at any time.
11. Limited license
While your account is active and compliant, the Company grants you a revocable, non-exclusive, non-transferable license to use approved Sharpr Picks names, marks, and creative assets solely to promote the Sharpr Picks brand. You must follow current brand guidance and stop using the materials when requested or when participation ends. You may not register or use any domain, application name, username, or social handle containing Sharpr marks.
12. Privacy
Enrollment information is handled in accordance with the Sharpr privacy policy. We use program data to operate the dashboard, attribute referrals, process payments, prevent fraud, communicate program changes, and satisfy legal or tax-reporting duties. Information may be shared with service providers where necessary for those purposes.
13. Disclaimers and liability
The Affiliate Program is provided “as is” and “as available,” without warranties of uninterrupted operation, referral volume, or earnings. To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, exemplary, or consequential damages. The Company’s aggregate liability arising from the program will not exceed the amount payable to you during the three months immediately preceding the event giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless B.Davis Management Inc. / Sharpr Picks (the Company), its owners, officers, employees, and agents from claims, losses, liabilities, penalties, and reasonable costs arising from your promotional practices, legal violations, or breach of these terms. This obligation includes claims based on messages, advertisements, representations, or content you create or distribute.
15. General
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved through binding arbitration on an individual basis, and you waive participation in class, collective, or representative actions. If any provision is held unenforceable, the remaining provisions remain effective. These terms, together with incorporated policies and notices, are the entire agreement concerning the Affiliate Program.
